“PATENT” COLUMN

If the “patent” column is blank in our list, you must request the variety’s tag.

But, many “patented variety” suppliers require Raker to supply tags for specific varieties. These varieties are indicated by a circle (●) in our “patent” column. These tags are shipped at no additional cost.

We also sell patented varieties that the breeder does not require us to supply tags. These tags may be bought from us with plant purchase verification. These varieties are indicated by a square (􀂄) in our “patent” column.

To clarify “patented variety”, when a plant receives a patent the law states:

“The grant, which lasts for 20 years from the date of filing the application, protects the inventor’s right to exclude others from asexually reproducing, selling, or using the plant so reproduced.”

This means you have the right to grow and sell your purchased plant, but not cut up the plant and start new ones.
